I motsats till vad som ofta antas \u00e4r YSE 1998 dock inte automatiskt till\u00e4mpliga p\u00e5 en byggentreprenad, utan de g\u00e4ller endast om villkoren uttryckligen har avtalats mellan parterna vid avtalets ing\u00e5ende.<\/p>\n<p>I entreprenadavtal mellan bostadsaktiebolag och byggentrepren\u00f6rer \u00e4r YSE 1998 vanligt f\u00f6rekommande. Efter detta kan ingen av parterna fr\u00e5ntr\u00e4da avtalet utan r\u00e4ttsliga f\u00f6ljder. Enligt YSE 1998 ska inneh\u00e5llet i till\u00e4ggs- och \u00e4ndringsarbeten i princip avtalas skriftligen innan arbetena p\u00e5b\u00f6rjas. Underl\u00e5tenhet att iaktta detta krav kan leda till att entrepren\u00f6ren inte erh\u00e5ller ers\u00e4ttning f\u00f6r utf\u00f6rt arbete.<\/p>\n<p>Parterna kan \u00e4ven i detta avseende avtala om ett f\u00f6rfarande som avviker fr\u00e5n YSE-villkoren. F\u00f6r att undvika bevissv\u00e5righeter b\u00f6r en s\u00e5dan \u00f6verenskommelse dock vara skriftlig och exempelvis utg\u00f6ra en del av entreprenadavtalet. Om YSE-villkoren inte till\u00e4mpas \u00f6ver huvud taget \u00e4r det s\u00e4rskilt viktigt att tydligt avtala om f\u00f6rfarandet vid till\u00e4ggs- och \u00e4ndringsarbeten.<\/p>\n<p>Till\u00e4ggs- och \u00e4ndringsarbeten leder ofta till f\u00f6rl\u00e4ngning av entreprenadtiden. Motsvarande konsekvens kan \u00e4ven f\u00f6lja av best\u00e4llarens f\u00f6rsummelser, exempelvis bristf\u00e4lliga planer. I praktiken kan en f\u00f6rsening orsaka best\u00e4llaren avsev\u00e4rt st\u00f6rre skada, varf\u00f6r det i vissa fall kan vara motiverat att avtala om f\u00f6rseningsvitets storlek och maximibelopp p\u00e5 ett s\u00e4tt som avviker fr\u00e5n YSE-villkoren.<\/p>\n<p>Entrepren\u00f6ren \u00e4r skyldig att visa n\u00e4r entreprenadarbetet \u00e4r f\u00e4rdigst\u00e4llt. I fr\u00e5ga om entreprenadens f\u00e4rdigst\u00e4llande framg\u00e5r detta ofta av protokollet fr\u00e5n mottagningsbesiktningen. N\u00e4r det g\u00e4ller delm\u00e5l \u00e4r situationen d\u00e4remot ofta mer komplicerad. Om f\u00e4rdigst\u00e4llandet och mottagandet av respektive delm\u00e5l inte har dokumenterats tillr\u00e4ckligt noggrant vid r\u00e4tt tidpunkt kan det i efterhand vara om\u00f6jligt att styrka dessa omst\u00e4ndigheter. Tvister som uppst\u00e5r till f\u00f6ljd av bristf\u00e4llig dokumentation hade ofta kunnat undvikas genom korrekt dokumentation fr\u00e5n b\u00f6rjan.<\/p>\n<p>Om YSE-villkoren inte till\u00e4mpas i entreprenaden b\u00f6r best\u00e4mmelser om f\u00f6rseningsvite uttryckligen tas in i entreprenadavtalet. Om s\u00e5 inte sker f\u00f6religger ingen skyldighet att betala f\u00f6rseningsvite. I s\u00e5dana fall kan entrepren\u00f6ren dock bli skyldig att ers\u00e4tta den skada som f\u00f6rseningen orsakat best\u00e4llaren, vilket i praktiken kan leda till ett betydligt h\u00f6gre ers\u00e4ttningsansvar \u00e4n ett avtalsenligt vite. Enligt YSE ska krav, med specificerade grunder, framst\u00e4llas redan vid mottagningsbesiktningen, vid \u00e4ventyr att r\u00e4tten att framst\u00e4lla kraven annars g\u00e5r f\u00f6rlorad.<\/p>\n<p>Krav som g\u00e4ller m\u00e4ngder och vars grunder har angetts vid mottagningen kan dock behandlas \u00e4ven i den ekonomiska slutredovisningen. I praktiken \u00e4r det inte ovanligt att krav inte framst\u00e4lls i tid, vilket kan medf\u00f6ra betydande ekonomiska konsekvenser f\u00f6r endera parten.<\/p>\n<p>Om YSE-villkoren inte till\u00e4mpas \u00e4r det viktigt att i entreprenadavtalet reglera vid vilken tidpunkt krav ska framst\u00e4llas. Fel som framtr\u00e4der under garantitiden ska entrepren\u00f6ren som utg\u00e5ngspunkt avhj\u00e4lpa p\u00e5 egen bekostnad.<\/p>\n<p>Det efterf\u00f6ljande tio\u00e5rsansvaret aktualiseras d\u00e4remot endast i begr\u00e4nsade situationer, n\u00e4mligen om felet beror p\u00e5 entrepren\u00f6rens grova v\u00e5rdsl\u00f6shet, ett v\u00e4sentligt kontraktsbrott eller ett v\u00e4sentligt \u00e5sidos\u00e4ttande av avtalad kvalitetskontroll. D\u00e4rut\u00f6ver f\u00f6ruts\u00e4tts att best\u00e4llaren inte sk\u00e4ligen kunde ha uppt\u00e4ckt felet vid mottagningsbesiktningen eller under garantitiden. Bevisb\u00f6rdan i dessa situationer \u00e5vilar best\u00e4llaren, vilket inneb\u00e4r en betydande ytterligare utmaning f\u00f6r best\u00e4llarsidan.
