S\u00e4ljaren ansvarar dock som utg\u00e5ngspunkt \u00e4ven f\u00f6r dolda fel och kan s\u00e5ledes inte undg\u00e5 ansvar genom att \u00e5beropa att han eller hon inte k\u00e4nt till felet. <\/p>\n<p>Vid bed\u00f6mningen av fel i bostadsk\u00f6p beaktas \u00e4ven k\u00f6parens unders\u00f6kningsplikt. K\u00f6paren ska noggrant unders\u00f6ka bostaden samt ta del av samtliga handlingar som s\u00e4ljaren har tillhandah\u00e5llit. S\u00e4rskilt ur k\u00f6parens synvinkel \u00e4r det viktigt att eventuella fel utreds p\u00e5 ett korrekt s\u00e4tt. Det \u00e4r relativt vanligt att parterna efter k\u00f6pet sinsemellan avtalar om kompensation f\u00f6r fel av mindre betydelse. Ett s\u00e5dant avtal kan dock visa sig vara till nackdel f\u00f6r k\u00f6paren, eftersom det kan f\u00f6rhindra att man senare \u00e5beropar fel som framkommer i efterhand och som kan ha betydande omfattning.<\/p>\n<p>N\u00e4r det finns misstanke om fel i bostaden ska objektets skick utredas p\u00e5 ett tillf\u00f6rlitligt s\u00e4tt s\u00e5 snart som m\u00f6jligt och alltid innan reparationsarbeten inleds. K\u00f6paren kan f\u00f6rlora sin r\u00e4tt att \u00e5beropa fel om dessa inte har utretts p\u00e5 beh\u00f6rigt s\u00e4tt f\u00f6re reparationer. V\u00e5r advokatbyr\u00e5 har goda kontakter med flera byggtekniska sakkunniga och kan vid behov koppla in en expert redan i ett tidigt skede av \u00e4rendet, s\u00e5 att bostadens kvalitetsfel utreds p\u00e5 ett korrekt s\u00e4tt. Vid bostadsk\u00f6p ska en reklamation g\u00f6ras inom tv\u00e5 \u00e5r fr\u00e5n det att besittningen \u00f6verl\u00e4mnades. Ofta \u00e4r felen dock s\u00e5dana att k\u00f6paren borde ha uppt\u00e4ckt dem betydligt tidigare. <\/p>\n<p>En reklamation b\u00f6r g\u00f6ras skriftligen och utan dr\u00f6jsm\u00e5l n\u00e4r felet uppt\u00e4cks. Prisavdragets storlek motsvarar i allm\u00e4nhet skillnaden mellan bostadens faktiska v\u00e4rde och dess v\u00e4rde i felfritt skick. Utg\u00e5ngspunkten \u00e4r s\u00e5ledes att bed\u00f6ma vilket pris som skulle ha avtalats om felet hade varit k\u00e4nt.<\/p>\n<p>K\u00f6paren kan \u00e4ven ha r\u00e4tt till skadest\u00e5nd om s\u00e4ljaren har handlat v\u00e5rdsl\u00f6st eller upps\u00e5tligen. I s\u00e5dana fall kan k\u00f6paren ha r\u00e4tt till ers\u00e4ttning f\u00f6r den skada som uppkommit till f\u00f6ljd av felet i bostaden. Skadest\u00e5ndet kan omfatta samtliga kostnader som felet orsakat k\u00f6paren, vilket inneb\u00e4r att ers\u00e4ttningsbeloppet kan vara avsev\u00e4rt h\u00f6gre \u00e4n ett prisavdrag.<\/p>\n<p>Om felet medf\u00f6r v\u00e4sentlig ol\u00e4genhet f\u00f6r k\u00f6paren och ingen annan p\u00e5f\u00f6ljd \u00e4r sk\u00e4lig, kan k\u00f6paren \u00e4ven ha r\u00e4tt att h\u00e4va k\u00f6pet.
